Terms of Service
The agreement between you and us when you use Upper Bazaar. Plain language, because terms nobody can read are terms nobody agreed to.
Version 2026-08-12 · in effect from 2026-08-12 · VixitAi Labs, Ranchi, Jharkhand
1. What Upper Bazaar is
Upper Bazaar, operated by VixitAi Labs, is a marketplace. The shops and service providers listed here are independent businesses in and around Upper Bazaar, Ranchi. They own their goods, set their own prices and decide their own stock.
We are not the seller. When you buy a kilo of dal through this site, your purchase is from that shop; our part is listing it, taking the order to them, and delivering it to you. This matters for who answers what — see section 7.
2. Using the site
- You need to be 18 or older to place an order.
- You sign in with your phone number and a one-time code. Keep that code to yourself — an order placed from your account is treated as yours.
- One account per person. Do not use the site to scrape the catalogue, hammer it automatically, or impersonate a shop or a member of our staff.
3. Where we deliver
We deliver inside defined zones around Upper Bazaar, Ranchi. Whether we can reach an address is decided by the pin you place on the map, not by the text of the address — so the pin is worth getting right. If a zone is closed (weather, a festival crowd, no riders available) we will tell you at checkout rather than accept an order we cannot fulfil.
4. Sample listings
While we are onboarding real shopkeepers, some listings are samples used to build and test the market. They carry a “Demo” label on the card and on the shop page, and they cannot be ordered from — checkout refuses them. If a listing has no Demo label, it is a real shop.
5. Placing an order
- Prices and availability come from the shop. A shop can be sold out of something between you adding it and checking out; we tell you which line is the problem rather than silently dropping it.
- An order can span several shops. It is then handled as one delivery but several separate parts — one shop refusing does not cancel the rest, and you are only charged for what is actually accepted.
- Some items are priced at the counter. Where a shop lists no price, we say so instead of guessing one, and that item cannot be added to a basket.
- Cash on deliveryis the normal way to pay: you pay the rider on your doorstep. Where online payment is offered, it happens on the payment provider’s page.
6. Delivery
- A rider may ask you for a delivery code shown in your order, and may take a photograph at handover. Both exist to settle later questions about whether an order arrived; the photograph is deleted after 30 days (see the Privacy Policy).
- Delivery windows are estimates. We do not publish an arrival time we cannot stand behind, which is why you will see a live stage rather than a countdown.
- If nobody is at the address and we cannot reach you, the order comes back to the shop. Repeated refusal of cash-on-delivery orders may mean we stop offering it to that account.
7. Who is responsible for what
- The shop is responsible for the goods: that they are what was listed, of the quality described, correctly weighed, within date, and legal to sell.
- We are responsible for the service we run: taking your order to the shop accurately, carrying the goods, handling your details as set out in the Privacy Policy, and settling refunds under the Refund & Return Policy.
- Where a delivery goes wrong in our hands — the wrong parcel, a damaged parcel, an order that never arrives — bring it to us and we will put it right. We do not bounce you to the shop for something a rider did.
- To the extent the law allows, our liability for any one order is limited to the value of that order. We are not liable for indirect losses.
8. Reviews
Only a delivered order can be reviewed, and only once — a review here stands on a completed delivery rather than on having an account. Write about the shop and the goods. We remove reviews that contain personal details, abuse, or anything unlawful, and we do not remove one merely because a shop dislikes it.
9. If you sell here
Listing a shop or a service is covered by a separate agreement — the Seller Agreement — which you accept before your listing goes for review.
10. Suspension
We may suspend an account that abuses the service: fraudulent orders, threats to riders or shopkeepers, repeated refusal of delivered goods, or attempts to break the site. Where we can say why, we will.
11. Changes to these terms
When these terms change materially, the version date at the top changes. Continuing to use the site after that means the new version applies to your future orders; an order already placed is governed by the terms in force when you placed it.
12. Governing law
These terms are governed by the law of India, and the courts at Ranchi, Jharkhand have jurisdiction over any dispute arising from them.
13. Reaching us
The fastest route is WhatsApp. A real person answers during market hours.
